Evergrace Movement Liability Waiver, Release of Liability & Media Release
Please read carefully. This waiver contains important information about your participation and legal rights.
By registering for or participating in any Evergrace Movement class, workshop, event, retreat, private session, pop-up, or wellness activity (collectively referred to as the "Activity"), I acknowledge that I have read, understood, and voluntarily agree to the following:
Assumption of Risk
I understand that participation in physical fitness and wellness activities—including but not limited to Pilates, yoga, barre, stretching, strength training, mobility exercises, sound healing, outdoor activities, hikes, wellness events, community gatherings, workshops, retreats, and the use of exercise equipment—involves inherent risks that cannot be eliminated regardless of the care taken by Evergrace Movement.
These risks include, but are not limited to:
Muscle strains or tears
Sprains
Fractures
Falls
Slips or trips
Equipment failure
Heat-related illness
Dehydration
Cardiac events
Allergic reactions
Illness
Property damage
Emotional distress
Permanent disability
Death
I voluntarily assume all known and unknown risks associated with participation.
Participant Health Statement
I certify that I am physically capable of participating in the Activity and have no medical condition that would make participation unsafe.
I understand that it is my responsibility to monitor my own physical condition throughout the Activity and immediately discontinue participation if I experience pain, dizziness, faintness, difficulty breathing, chest pain, or any other concerning symptoms.
Medical Responsibility
I understand that it is my responsibility to consult with my physician or qualified healthcare provider before participating if I have any medical condition, injury, illness, pregnancy, recent surgery, or any other health concern that could affect my ability to safely participate.
I acknowledge that Evergrace Movement does not provide medical advice and that participation is voluntary.
Pregnancy
If I am pregnant or become pregnant, I certify that I have consulted with my healthcare provider regarding participation and voluntarily accept all risks associated with participating in the Activity.
Personal Equipment
I understand that I am responsible for ensuring that any personal equipment I bring to the Activity, including but not limited to yoga mats, water bottles, resistance bands, towels, or other personal items, is clean, safe, and in good working condition.
Emergency Medical Care
If I become injured, ill, or incapacitated during the Activity, I authorize Evergrace Movement and its representatives to obtain emergency medical treatment on my behalf if deemed necessary.
I understand that I am solely responsible for any medical expenses incurred.
Release of Liability
To the fullest extent permitted by the laws of the State of Texas, I release, waive, discharge, and covenant not to sue Evergrace Movement, its owner, instructors, employees, contractors, volunteers, affiliates, sponsors, collaborating businesses, event hosts, venue owners, landlords, vendors, partners, and all associated individuals and entities from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, attorney's fees, or judgments arising out of or related to my participation in the Activity, including claims arising from ordinary negligence.
This release includes, but is not limited to:
Bodily injury
Illness
Property damage
Emotional distress
Disability
Death
Financial loss
Any other injury or damages sustained before, during, or after participation.
Nothing in this agreement is intended to release liability where such a release is prohibited by applicable law, including liability for gross negligence, reckless conduct, or intentional misconduct.
Personal Property
I understand that I am solely responsible for my personal belongings.
Evergrace Movement is not responsible for any lost, stolen, or damaged personal property.
Venue Conditions
I understand that Activities may take place indoors or outdoors.
Weather conditions, flooring surfaces, terrain, lighting, equipment, and environmental conditions may vary.
I agree to exercise reasonable care for my own safety at all times.
Food & Beverage
If refreshments, coffee, snacks, or beverages are provided by Evergrace Movement or third-party vendors, I understand that I am solely responsible for determining whether such items are appropriate based on allergies, dietary restrictions, or medical conditions.
Evergrace Movement assumes no responsibility for allergic reactions or food-related illnesses.
Photography & Media Release
I understand that photographs, videos, and other media may be captured during Evergrace Movement classes, workshops, events, retreats, and Activities.
By participating, I grant Evergrace Movement, its representatives, sponsors, affiliates, collaborating businesses, partners, and event hosts the irrevocable right and permission to photograph, film, record, edit, publish, reproduce, distribute, and use my image and likeness in photographs, videos, recordings, and other media for marketing, promotional, educational, advertising, website, print, digital, social media, and other lawful business purposes without compensation or further permission.
I understand that I waive any right to inspect or approve the finished materials.
If I do not wish to appear in photographs or videos, I understand that it is my responsibility to notify Evergrace Movement in writing before the Activity. While reasonable efforts will be made to accommodate my request, I understand that Evergrace Movement cannot guarantee that I will not appear incidentally in group photographs or recordings taken during public events.
Participant Conduct
I agree to follow all instructor directions, event guidelines, and safety instructions.
Evergrace Movement reserves the right to remove any participant whose behavior is unsafe, disruptive, abusive, intoxicated, or otherwise inappropriate without refund.
Late Arrival Policy
For the safety and experience of all participants, Evergrace Movement reserves the right to deny participation to attendees who arrive after instruction has begun if entry would disrupt the class or compromise safety.
Cancellation & Refund Policy
Unless otherwise stated, all registrations are final.
Event registrations are non-refundable unless the Activity is canceled by Evergrace Movement.
Evergrace Movement reserves the right to modify instructors, schedules, locations, or event details when necessary.
Illness Policy
I agree not to attend the Activity if I am experiencing symptoms of a contagious illness or have been advised by a healthcare provider to isolate.
Minors
Participants under eighteen (18) years of age must have this waiver reviewed and accepted by a parent or legal guardian prior to participation.
Accessibility
Participants requiring reasonable accommodations are encouraged to contact Evergrace Movement before the Activity so reasonable efforts can be made to accommodate their needs.
Severability
If any provision of this agreement is determined to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.
Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of Texas.
Any disputes arising from this agreement shall be resolved in accordance with applicable Texas law.
Acknowledgment
By checking the agreement box during registration, I acknowledge that:
I have carefully read this Liability Waiver, Release of Liability, and Media Release.
I fully understand its contents.
I understand that participation in physical activity involves inherent risks.
I voluntarily assume those risks.
I understand that I am giving up certain legal rights, including the right to bring certain claims to the fullest extent permitted by law.
I voluntarily agree to all terms of this agreement without coercion.
I understand that this agreement applies to all Evergrace Movement classes, workshops, retreats, pop-ups, and wellness events unless otherwise stated.
I certify that I am at least eighteen (18) years of age or that this agreement has been accepted by my parent or legal guardian.
